Important notice regarding recent Morgan Hill lawsuit

A recent lawsuit against the California Department of Education (CDE) is impacting all school districts across the state, including the Ackerman Charter School District (ACSD). We wanted to make you aware of this and provide you with an opt-out form and other important information regarding this case.

In April 2012, two organizations, the Morgan Hill Concerned Parents Association and the Concerned Parent Association, filed a lawsuit against the CDE alleging widespread, systemic non-compliance by local education agencies with special education laws. Our District was not involved in the lawsuit and is not the subject of any of the suit’s allegations.

Nonetheless, as a part of this lawsuit, CDE has been ordered by the United States District Court to release all data it has collected on all students, both general and special education, since January 1, 2008. Examples of information that may be released includes student’s name, social security number, demographics, course information, statewide assessment results, teacher demographics, program information, behavior and discipline information, progress reports, special education assessment plans, special education assessments/evaluations, Individualized Education Programs (IEPs), records pertaining to health, mental health and medical information, student statewide identifiers (SSID), attendance statistics, information on suspensions and expulsions, and results on state tests.

Parents/Guardians have the right to complete and mail in the below linked Opt-Out Form to prevent the release of student data: http://www.cde.ca.gov/re/di/ws/documents/form2016jan26.pdf. The objection form must be submitted via regular mail to the Court (address provided in opt-out form) by April 1, 2016.

We want to do all we can to help you keep it protected and to keep our families informed about the impacts of these types of Court orders. We’d like to reiterate that the release of this information is completely out of Ackerman Charter School District’s control, and out of concern for our student community, we want to ensure our families know they have the option to protect their student’s private information.
